Do I need a Will?
Only if you have property and you care about what happens to it when you die. Otherwise, no, you don't need a Will. Can a Judge re-write my Will when I am dead? There are a number of laws that apply on death including the Family Protection Act and statutes relating to Testamentary Promises, Relationship Property and mutual Wills. Any of these can result in a Judge interfering with the wishes you express in your Will. What can I do about that? The time to take advice on these matters is when your thinking about writing a new Will. Don't leave it too late. I will be dead anyway - why should I worry? Most of us worry about what kind of mess we leave our families when we are gone. If you want things to be as simple as possible for them: take the time; take good advice; contact us.
